1. TERMS OF USE

1.1 All use of the website https://www.toursinbelgium.com (“the Site”) is on the terms and conditions below. If you do not agree to these conditions cease use of the Site immediately.

1.2 You may print and keep a copy of these terms. They are a legal agreement between us and can only be modified with my consent. I reserve the right to change the terms at my discretion by changing them on the Site.

1.3 By using https://www.toursinbelgium.com or any affiliated website, you agree to be legally bound by these terms, which shall take effect immediately.

1.4 If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use https://www.toursinbelgium.com.

1.5 I may change these Terms & Conditions at any time by posting changes online. Please review these Terms & Conditions regularly to ensure you are aware of any changes made meanwhile, if any. Your continued use of https://www.toursinbelgium.com after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

1.6 You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use https://www.toursinbelgium.com content (inclusive of text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. Any other use of https://www.toursinbelgium.com content requires the prior written permission from me, Antranik Manukyan.

1.7 You agree to use https://www.toursinbelgium.com only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of https://www.toursinbelgium.com.

1.8 Your use of https://www.toursinbelgium.com is intended for personal, non-commercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this site to make any speculative, false or fraudulent requests. You agree not to use robots or other automated means to access this site, unless specifically permitted by me, Antranik Manukyan.

1.9 Goods or services available for purchase on the Site, such as hotel, theatre bookings, attractions or museums tickets, flight and all the services, that are directing the user to other websites, are provided by other companies and comprise a contract between the user and those companies, not me, Antranik Manukyan. Although I use reasonable endeavors to ensure reputable suppliers are used on my site, I accepts no liability arising from supplies by such partners. All such sales are on the terms and conditions of the provider and the user which may be accessed from my website.

2. PRICES

2.1 Prices shown on my website are per group of people or per person, unless otherwise stated.

2.2 Prices are subject to change, until the booking has been confirmed.

2.3 Group prices are specified on the individual tour pages. For larger groups or special requirements, an individual quotation may be provided upon request.

2.4 Children under sixteen must be accompanied by an adult.

2.5 Prices do not include (unless stated otherwise) – gratuities, food and beverages and transport costs.

2.6 Gratuities are entirely at your discretion and are not obligatory.

2.7 There are no additional surcharges once a tour/trip/service is booked, unless you would like to add extra services to your already purchased tour/trip/service or unless in the price offer is written that certain services, entry to museums and attractions, which are part of the tour itinerary, are not included in the price.

3. PAYMENT METHODS & POLICY

3. Payment Methods and policy

Once an agreement between me and the client is made for a specific private tour, trip or service, I would ask for a bank transfer payment for the negotiated services. Upon negotiation, the requested amount can be paid partially as a deposit via a bank transfer and the rest in cash on spot. Please note that I always require a certain amount to be paid via a bank transfer or payment link in advance, in order to guarantee your reservation and it should not be less than 50% from the total negotiated price. The remaining amount can be transferred either again via a bank transfer or via a payment link, or can be negotiated to be paid cash upon meeting.

Please note that I may request proof of payment, if the payment is made less than one week before the start of your tour, trip or service.

Certain museums and attractions on a tour require purchasing tickets in advance and I would ask in those case the full payment of those services via a bank transfer or a payment link in advance.

4. MEETING POINTS

4. Each tour has a standard, advisable location for the meeting point. However, as my tours are private, this enables you to choose your desired location for the meeting point, depending on your preferences. Please note that meeting points, which are further than 1km from the route of the selected tour, may incur an additional charge.

5. AMENDMENTS & CANCELLATIONS

5.1 I apply 30% cancellation fee on the amount being paid to my bank account, if the customer decides to cancel a tour up to 4 weeks before the tour date. Otherwise a 100% charge will apply on the paid amount, if the customer decides to cancel a tour within 4 weeks from the beginning of the tour.

5.2 If a customer decides to change the date of already booked tour, this can be done without additional fees, only if it is within 30 days from the initially booked date and only if I am available for the newly requested date.

5.3 Tickets and other third-party services purchased on behalf of the customer are subject to the cancellation, amendment and refund conditions of the relevant supplier. Where a ticket or service is non-refundable or non-amendable under the supplier’s conditions, the corresponding amount cannot be refunded or amended by me.

5.4 Where permitted by applicable consumer law, bookings for leisure services to be provided on a specific date or during a specific period are not subject to the general 14-day right of withdrawal.

6. REFUNDS, COMPENSATION & COMPLAINTS

6.1 Any complaint or request for a refund should be submitted in writing to info@toursinbelgium.com as soon as reasonably possible and preferably within 7 days after completion of the tour or service. I will normally respond within 3–5 working days. This does not affect any statutory rights available to the customer.

6.2 In the event that I have purchased tickets for certain museums, attractions or events, that cannot be visited during a tour due to unforeseen circumstances, I will do my best to request a refund from the providers, however this action is based exclusively on the provider’s terms & conditions. If such refund is granted, the returned amount will be paid back to the customer.

6.3 All the theater, attractions and event tickets are not refundable. All sales are final, tickets cannot be exchanged or money refunded once booked.

6.4 All third party products and services, where I act as an official agent, are non-refundable under any circumstances and are also subject to the terms and conditions of the product/service supplier.

6.5 If you booked my services via another tour operator/travel agency, and thereafter you have specific claims for refunds or compensations, they should be addressed to the company, from which you booked my services, according to their terms & conditions.

6.6 If, due to my fault I am unable to accomplish already booked and paid tour guiding services for a specific date, the whole paid amount will be refunded back to the customer within a maximum of 7 working days.

6.7 I want you to enjoy your experience with me. Sometimes, however things do not go according to plan and if you feel that I have not lived up to your expectations, or that I could improve my service in some way. Please let me know by info@toursinbelgium.com and I will respond to you within 3 – 5 business days.

7. TOUR INFORMATION

7.1 Should the customer fail to arrive on time for a private tour or arrives later than the negotiated time, I am obliged to commit my duties only within the remaining time for the booked period. In those circumstances we may skip some points of interest due to lack of time.

7.2 I am not responsible for loss, damage, delay or inconvenience resulting from circumstances beyond my reasonable control. Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable Belgian law.

7.3 My tour guiding services are based and charged on specific timing, mentioned for each tour. If you would like to extend this timing, please bear in mind that any overdue time will be charged additionally. In those cases, if my availability allows so, we can agree on a specific price for the overdue timing, depending on the desired extension of timing and the number of people in a given group.

7.4 If aggression or indecent behavior is used by a customer during a tour, I have every right to immediately terminate a given tour without being obliged to refund the customer.

8. GOVERNING LAW AND JURISDICTION

8.1 These Terms & Conditions and any booking made through this website are governed by Belgian law. This choice of law does not deprive consumers of any mandatory rights or protections available to them under applicable consumer law. Any dispute arising from these Terms & Conditions or from a booking shall be submitted to the competent courts in accordance with applicable Belgian and European Union rules on jurisdiction.

8.2 I will store and use the information you supply me or which is supplied to me in your use of this Website for the purposes set out in my Privacy Policy. You will be/would have been asked to agree to my use of your information at the appropriate time. If you do not agree, I cannot interact with you or accept your booking. Please read my privacy policy carefully prior to make a booking or inquiry request. My Privacy Policy is an integral part of these Terms & Conditions. 8.3 By submitting reviews and contributions on this website or my email address (info@toursinbelgium.com), you are granting me a nonexclusive, perpetual, royalty-free, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute and display such content throughout the world via any media. By submitting your review you represent and warrant that:– you own or control the content of your review and it is your own original work;– the content is not defamatory and does not infringe any applicable laws and – the content is accurate, truthful and your own genuine opinion and– you will indemnify and hold harmless me for all damages, costs and expenses incurred for breach of these warranties.
